Privacy Policy

PoCap is a product of CyberForge Software Co. ("CyberForge", "we", "us", or "our"), a company established in the State of Kuwait. This Privacy Policy explains how CyberForge, as the owner and operator of PoCap, collects, uses, stores, and protects your personal data when you use the PoCap mobile application and related services (together, the "Service").

We prepared this policy to comply with the laws of the State of Kuwait, including the Data Privacy Protection Regulation issued by the Communication and Information Technology Regulatory Authority (CITRA Resolution No. 42 of 2021) and the Electronic Transactions Law No. 20 of 2014, as well as the privacy requirements of the application marketplaces through which the app is distributed.

By creating an account or using the Service, you consent to the collection and processing of your personal data as described in this policy. If you do not agree, please do not use the Service.

1. Data we collect

Information you provide

• Account information. Your email address, username, and sign-in credentials, or the identifier provided when you sign in with a supported sign-in service.
• Photos you capture. Photos you take or upload in the app for the purpose of generating an AI-processed portrait.
• Support communications. Messages you send us when you contact support.

Information collected automatically

• Usage and job history. The styles you select, processing requests, and the results delivered to your account.
• Purchase records. Records of credit purchases made through the app marketplace's billing system. We do not collect or store your card details. Payment is handled entirely by the marketplace operator.
• Device and technical data. Device model, operating system version, app version, language settings, and push notification tokens.
• Diagnostic data. Crash reports and performance data used to keep the Service stable.

2. How we use your data

• To create and manage your account.
• To process the photos you submit and deliver the finished portraits to you. This is the core purpose of the Service.
• To operate the credit system and apply your purchases to your balance.
• To send you service notifications, such as when a photo is ready, where you have allowed notifications.
• To respond to your support requests.
• To secure the Service, prevent fraud and abuse, and comply with our legal obligations under the laws of Kuwait.

We process your personal data only with your consent or where processing is necessary to provide the Service you requested, to meet a legal obligation, or to protect our legitimate interests in operating the Service securely.

3. Your photos

• Photos you capture are uploaded securely and used solely to generate the portrait you requested.
• Your photos and results are delivered to your account only. They are not published, shared with other users, or used for advertising.
• We do not use your photos to train artificial intelligence models.
• You can delete any photo or result from within the app at any time. Deleting a result removes it from our active systems.

4. Sharing of data

We do not sell your personal data. We share data only in the following limited cases:

• Service providers. We use carefully selected providers for hosting, storage, and photo processing. They act on our instructions, receive only the data necessary to perform their function, and are bound by confidentiality and data protection obligations.
• Legal requirements. Where disclosure is required by the laws of the State of Kuwait, by a court order, or by a competent authority such as CITRA.
• Business transfers. If CyberForge is involved in a merger, acquisition, or sale of assets, your data may be transferred as part of that transaction subject to this policy.

5. International transfers

Some of our processing infrastructure may be located outside the State of Kuwait. Where personal data is transferred outside Kuwait, we take steps to ensure it receives an adequate level of protection consistent with the CITRA Data Privacy Protection Regulation, including contractual safeguards with our providers. By using the Service you consent to such transfers.

6. Retention

• Account data is kept for as long as your account exists.
• Photos and results are kept until you delete them or delete your account.
• Purchase and transaction records are kept for the period required by Kuwaiti law for accounting and audit purposes.
• When data is no longer needed, it is deleted or anonymised securely.

7. Security

We apply technical and organisational measures appropriate to the sensitivity of the data we process, including encryption in transit, access controls, and secure storage. No online service can guarantee absolute security, but we work to protect your data against unauthorised access, alteration, disclosure, and destruction, and we will notify you and the competent authority of any data breach where required by Kuwaiti law.

8. Your rights

Subject to the laws of Kuwait, you have the right to:

• Access the personal data we hold about you.
• Request correction of inaccurate data.
• Request deletion of your data and your account. You can delete your account directly in the app, and account deletion removes your personal data from our active systems.
• Withdraw your consent at any time, which will stop future processing but does not affect processing already carried out.
• Lodge a complaint with the Communication and Information Technology Regulatory Authority (CITRA) in Kuwait.

To exercise any of these rights, contact us using the details below. We will respond within the period required by applicable law.

9. Children

The Service is not directed at children under the age of 13, and we do not knowingly collect personal data from them. Users under the age of 18 may use the Service only with the consent and supervision of a parent or legal guardian. If you believe a child has provided us personal data, contact us and we will delete it.

10. Device permissions

The app requests the following permissions, each only for the stated purpose:

• Camera. To capture the photo you want processed.
• Photo library. To save finished portraits to your device when you choose to.
• Notifications. To tell you when your photo is ready. This is optional and can be turned off in your device settings.

You can withdraw any permission at any time through your device settings. The related feature may stop working, but the rest of the Service remains available.

11. Changes to this policy

We may update this policy from time to time. If we make material changes, we will notify you in the app or by other reasonable means before the change takes effect. The "Last updated" date at the top shows the latest revision.
